TRENDSPLANT X DREAMSEA INSTAGRAM DRAW CONDITIONS

 

 

ORGANIZER DETAILS

The draw organizing body is Trendsplant S.L. (hereinafter “the organizer”), with headquarters at Calle Pintor Cabrera, 14, local 18, 03003, Alicante, holder of Tax ID no. B54459532. Trendsplant will make the draw conditions available to participants on Instagram on 07/14/2021 at 12 p.m. CEST. These will be removed on 07/21/2021 at 23.59 p.m. CEST. Instagram users who meet the requirements described below may participate in the draw (hereinafter, the “draw”). DISCLAIMER: The draw is not sponsored, endorsed or administered by or associated with Instagram in any way. 

 

AREAS: TERRITORIAL AND TEMPORAL

There is no territorial limitation to participating in the draw, and participation is valid anywhere in the world. The period for participating in the draw shall begin on 07/14/2021 at 12 p.m. CEST and shall end on 07/21/2021 at 11.59 p.m. CEST. Users outside these dates will not be able to participate in the draw. Trendsplant reserves the right to postpone, extend, suspend, cancel or modify the duration of the draw at any time before its completion, for justified reasons that will be published through communication channels or on the social media profiles owned by the organizer.

 

DRAW PROCEDURE AND CONDITIONS FOR PARTICIPATION

In order to participate in the draw, the following requirements must be met. Users who do not meet them shall not be permitted to participate in the draw: 

1. Follow @trendsplant and @dreamseasurf Instagram accounts.
   
   
2. “Like” the draw publication. 
   
   
3. Comment on the draw publication and mention the person with whom you would like to go (each comment with a new person tagged counts as a new chance to participate in the draw). 
   
   
4. Share the draw post in user stories and tag @trendsplant and @dreamseasurf. 

The organizer reserves the right not to admit or expel as a participant any user who prevents or hinders in any way the proper operation of the draw and/or in any event who acts in any way that may be regarded as abusive, contrary to good faith and principles of independence, impartiality and/or objectivity of the draw result.

 

NOTICE OF DRAW RESULT AND WINNER

The draw shall take place on July 22nd at 12 p.m. CEST, via an independent application that shall guarantee the correct operation of the draw. 

Draw participants who comply with all the requirements stipulated in these legal bases shall opt for the following experiences on a joint basis:

1. A week at one of the Dreamsea Surf locations in Europe. The winner of the draw may choose the destination provided, as has been stated, it is in Europe and he/she may be accompanied by someone. He/she shall be provided with a week’s accommodation. Meals for both people shall be provided as well as surfing equipment and classes.
   
   
2. A discount code for € 500 that can be redeemed on the www.trendsplant.com website for Trendsplant items and products.

The winner of the draw shall have a year to redeem both experiences, which are those he/she may choose for having participated in the aforementioned draw. 

Trendsplant will ensure that the contestants comply with all the necessary requirements as detailed in these legal bases in order to be able to access the draw. 

If Trendsplant does not receive a reply from the winning user within 48 hours from the notification of the result, or if the winning user rejects the experiences, it shall be assumed that the aforementioned winning user expressly waives the experiences, and a new winner shall be chosen at random. 

In the event that the next winner chosen does not respond within a new period of 48 hours from notification, the organizer reserves the right to decide as to how to proceed, and may even choose not to proceed further.

 

TAX LIABILITIES

All relevant tax provisions shall be applied to the experiences of this draw in accordance with current Spanish legislation.

 

DATA PROTECTION

In accordance with the stipulations of Law 15/1999 (December 13th) on the Protection of Personal Data, all personal data provided by the user as part of his/her participation in the draw shall be processed in accordance with the stipulations of the aforementioned Privacy Policy: https://www.trendsplant.com/en/content/3-terms-conditions

The data provided by the participant shall be used for commercial purposes only and shall not be shared with third parties. Please note that when you complete the form and provide us with your email address, you agree to receive electronic communications and be part of the Trendsplant database.

 

DISCLAIMER

The organizer is not responsible for possible losses, deterioration, delays or any other circumstance attributable to third parties or the Internet that may affect participation in this draw.

 

CHANGES TO THE TERMS OF USE

Trendsplant may review and update these Terms of Use from time to time at our sole discretion. All changes are effective immediately when we post them and shall apply to all access and use of the website thereafter. Your continued use of the website after the publication of the revised terms of use shall signify that you accept and agree with the changes. You are expected to check this page from time to time in order to be familiar with any changes, as they are binding upon you.

INTERPRETATION OF CLAUSES

In the event that any of the clauses of these legal bases is rendered void, the rest of the clauses must be interpreted independently and autonomously and shall not be affected by the clause that has been declared void.  

 

JURISDICTION AND APPLICABLE LAW

This draw and its respective legal bases shall be governed by current Spanish legislation. For any dispute or difference that may arise as a result of the interpretation, execution or resolution of this contract, the parties shall submit to the jurisdiction of the competent Courts of Alicante, expressly waiving their rights to any other jurisdiction to which the user may be entitled by law. Participation in the competition shall entail the acceptance of each and every one of the conditions stipulated in these Terms and Conditions and the respective declaration of winners once this is finalized.
